“Nye County District 4 Commissioner Butch Borasky filed a court challenge to his recall election late Monday afternoon.
A court date hasn’t been set yet. But Nye County Clerk Sam Merlino said it’s unlikely an Oct. 21 recall election could still be held.
She canceled plans to advertise the election.
The lawsuit claims it is the duty of the county clerk to verify the signatures on the recall petition of people who actually voted in District 4 in the November 2006 election — 2,607 voters — as noted in an interpretation by the Secretary of State issued March 25, 2008. That is backed up by a May 13, 2008, letter from the Nevada Attorney General”
